If you own a business, there's a chance that you may find yourself considering hiring a foreign national to your company. Maybe your agricultural concern needs additional laborers or your pharmaceutical company needs a prestigious foreign chemist. The fact is, a foreign national may be the best man or woman for the job. But to hire him or her, you'll have to jump through a few hoops first.
The main thing you'll need to do to legally employ a foreign national is to secure your prospective employee a visa. A visa allows a foreigner to come into the United States legally, and there are many different types of visas that apply to certain specific situations. Some visas apply only to people visiting the country on vacation, while others are specifically for people seeking work in the United States. Depending on the kind of work, the length of time the visa allows that person to be in the country may vary dramatically.
Some of the most common types of work visas are:
O Visa. The O Visa is for "foreign nationals with extraordinary ability in Sciences, Arts, Education, Business, or Athletics." This applies to someone who has an international reputation in their field (which must be proved in order to obtain the visa).
L Visa. The L Visa applies to employees who are transferring to the United States while remaining in the same company. If you have an employee at your office in Singapore and you wish to relocate him to your office in Oakland, this is the visa type you will need.
I Visa. The I Visa applies to journalists and other people in the media field.
TN Visa. One of the newer types of visa, the TN is for citizens of NAFTA countries (Canada, the US, and Mexico) who are moving to each other's countries for professional reasons.
J Visa. The J Visa is for doctors, professors, religious workers, and other scholars.
H1-B. The H1-B Visa is one of the most well-known work visas, specifically for specialty occupations that require highly specialized knowledge.
H2-A. The H2-A Visa allows temporary or migrant laborers to work in the United States.
